Deidre Henderson. Their brief tells the justices to wait until after November 3. North Carolina has already mailed ballots. Military and overseas envelopes must go out by September 19. Offices, they say, have already bought paper and trained staff. Implementing barcodes, recipient lists, and a Federal Ballot Mail Portal now would cause “mistakes, delays, and confusion.”
They take no position on whether the Postal Service even has the authority to issue the rule. They just want one more election under the old pipe. That is the tell. If the rule is lawless, fight it on the merits. If the portal is sloppy, demand a test. Asking the Court to look away until the votes are cast is the same move Senate leadership used on the SAVE Act: keep the fight alive, keep the floor quiet, keep the old system through the only date that matters.
The rule is not a rumor. Trump’s March executive order and the August 21 USPS final rule require states that mail federal ballots to enroll recipient lists, print unique barcodes on outbound and return envelopes, and meet design standards. The Court now has to decide whether “we already ordered the envelopes” beats a federal standard written to show who got a ballot and whether it came back. Logistics is the costume. The prize is November 3 under the old rules.
