Biden Autopen Scandal Deepens: Key Aides Invoke Fifth, Fueling Calls for DOJ Probe

The controversy surrounding former President Joe Biden’s alleged reliance on an autopen for official signatures has escalated into what Republicans are branding the “biggest political scandal in American presidential history.”

A blistering 100-page report released last week by the House Oversight Committee exposes a pattern of cognitive decline, White House deception, and potentially invalid executive actions, with all key witnesses now stonewalling investigators by pleading the Fifth Amendment.

The report, titled “The Biden Autopen Presidency: Decline, Delusion, and Deception in the White House,” details how Biden’s inner circle allegedly shielded his deteriorating mental acuity by routing decisions through aides and using the autopen—a mechanical device for replicating signatures—on critical documents like pardons and executive orders.

Chairman James Comer (R-Ky.) declared all such actions “null and void,” urging Attorney General Pam Bondi to launch a full Department of Justice investigation. “This wasn’t just incompetence; it was a cover-up that undermined the Constitution,” Comer stated, pointing to evidence from over a dozen interviews revealing aides preemptively signing off on policies without Biden’s direct involvement.

At the heart of the impasse are three central figures: Dr. Kevin O’Connor, Biden’s longtime physician; Anthony Bernal, chief of staff to First Lady Jill Biden; and Annie Tomasini, deputy chief of staff for operations. During subpoenaed depositions in July, each invoked their Fifth Amendment rights against self-incrimination, refusing to answer core questions about lying on Biden’s health, his fitness for office, or whether unelected officials usurped presidential duties.

O’Connor dodged queries on directives to falsify medical reports; Bernal evaded admissions of family meddling in governance; and Tomasini blocked probes into schedule manipulations to hide fatigue. Their uniform silence, the report argues, perpetuates the deception even post-presidency.

Democrats dismissed the findings as a partisan “sham,” lacking concrete proof of conspiracy and serving as a distraction from GOP priorities.

Yet the revelations have reignited public fury, with polls showing 62% of Americans believing Biden’s team concealed his condition during his 2024 reelection bid. As Trump administration officials weigh overturning affected policies—from clemency grants to regulatory rollbacks—the scandal threatens to redefine accountability in the executive branch. With witnesses clamming up, the truth may remain buried, leaving a cloud over Biden’s legacy and fueling endless litigation.
