The Compulsory Premium And Big Insurance Legal Corruption

Forced Profits

WASHINGTON — Property and casualty insurance is a statutory business. States require drivers to carry liability coverage. Coastal states effectively require homeowners to carry wind coverage if they want a mortgage. The premium is collected under the force of law. The carrier that collects it is private. The arrangement has produced large profits in quiet years and large rate increases after active ones. It has also produced a permanent lobbying presence in every state capital and in Washington.

Florida’s 2004 and 2005 seasons tested the model. Four hurricanes in 2004 and three more in 2005 generated tens of billions in claims. Allstate reported more than a billion dollars in storm losses and stopped writing new homeowners policies in most of the state until the legislature adjusted the catastrophe fund. Several Florida-only carriers became insolvent; their unpaid claims were shifted to the state’s guaranty association and ultimately to remaining policyholders. National carriers, protected by reinsurance and by profitable lines written elsewhere, posted overall industry profits in 2005. Rates in Florida rose sharply afterward. Some carriers reduced coastal exposure or exited. The legal requirement to buy coverage remained. The carriers that stayed or returned did so under the revised statutes the legislature wrote after the storms.

The political channel is documented and legal. Insurance PACs contributed more than $24 million to federal candidates in the 2023–2024 cycle. State-level giving in Florida is continuous. In the current governor’s race, property insurance is the central issue. Republican Byron Donalds and Democrat David Jolly offer different remedies—transparency and private-market transfers versus a larger state catastrophe fund. Campaign-finance records show industry-adjacent money on both sides of the contest. No candidate runs without it. The statutes that set rate review, Citizens Property Insurance eligibility, and assignment-of-benefits rules are written by legislators who receive those contributions. The arrangement is not a secret payment for a specific bill. It is a permanent relationship between a compulsory product and the people who write the compulsion.

The Affordable Care Act’s individual mandate followed the same logic: a legal requirement to purchase a private product, with penalties for noncompliance, justified as a way to stabilize the risk pool. The Supreme Court upheld it as a tax. Auto insurance supplied the precedent in the public argument. The result was another large transfer into private carriers under federal and state rules. Florida remains the clearest state-level version of the model—high exposure, statutory coverage requirements, a residual market, and a political class that has spent two decades adjusting the rules after each major season. The premiums are mandatory. The carriers are not. The difference is written into the statutes the industry helps shape.
